The reason for the 'double standard' is that even if the music isnt the same it can get copyright claimed by music companies, their extremely notorious for false striking videos on youtube for people humming a song too effectively for instance.
I've even seen examples of people getting copyright claimed without even saying any lyrics or there being any tune in any way, a algorithm just flagged a few seconds of random ambient noise as some song, while something like this would be easy to remove manually it will kill things that just sound similar.
AI music bots or programs could likewise face similar attack from these super over-zealous companies, a large deal of which do this sort of wide claiming tactic as a way to make money off the people who dont bother to contest the claims.
So this isnt a 'double standard' its just that the music industry is massively more hostile commercially and therefore makes stuff like this a lot harder.
