So when you're talking about these web based AI services your control is limited to prompting, but did the copyright office's report contemplate if you are hosting (or better yet built) your own model and you actually control and vary parameters and settings of the model in addition to changes in the various prompts and contexts? That can get models to behave in a more consistent and controllable manner (like the camera example you gave). I get the easiest path is just do something as a person as part of the final production and the recording is protected, but at least as presented here the "black box" critique versus the threshold for a human did something copyrightable seems to over simplify the range of use possible in the space. I get that most folks would not have the technical expertise or infrastructure to do it themselves, and rely on the various web based services to do this for them, but using the same logic is the work generated by David Cope's Experiments In Musical Intelligence too AI for protections? Would Mozart's compositions with dice games be too AI for protections, because the generative ai's of today come from foundations decades if not centuries old.
