There are two differences between a human and a AI 1. AI cannot produce art, it tries to produce something that matches the prompt it was given and that's it 2. AI is VERY good at doing the former. If you buy a copy of an avengers movie and process the imagery through an AI, the AI will adjust it's billions of parameters so it gets a detailed idea of what a Capitan America is. So, since AI doesn't forget, it will be able to give you an extremely close depiction of what a Capitan America is without needing to look at a reference (of course if you ignore the artifacs like 6 fingers or so). It would never be able to match exactly any given frame of the movie because the video data is not really inside of the AI, so really theres no difference between this and what a human does EXCEPT for how good it's at it. And that can not be classified as theft. You CAN still poison your art even though AI is not stealing it, this is because you CAN discriminate against AI simply because you don't like it, because AI is not a person so it has no human rights.
