That was true of v1 of Stability AI"s models which used the lion5b dataset scraped from the web. However with v2 model they are using a copyright safe model which is consequently much worse at humans as it is effectively using old masters as reference works. I suspect that they can get around most legal issues in that manner as that was the intent. Though I do think glossing over the technical issues, is why so many artists think art is stolen. When in actuality this is much more akin to tracing. Where at best you get an outline, without any real understanding. Art trained directly on a given artist's art will look a lot more like the artist's work. Though your argument then becomes with an individual and not a company. This was also the design of Stability AI for V2 of its model. I guess you will find that out in court, and should advise your lawyer of such.
