On musicians being protected from being sampled by AI: DMCA. It's such a wide spreading legal net that's been weaved into so many of the biggest music distribution platforms online these days that any piece of music that sounds even remotely like a DMCA protected music, even if it's not actually protected by DMCA, will get a strike. It's a system that's been around for a long time. And while it's proven to be a pain in the ass to deal with for many online creators, this is one instance where it's actually a force for good. Digital artists don't have that kind of copyright protection, and it's high time that such a system should be implemented. Deviant art has a system that tells the artist when their art is being scraped for use as an NFT, they could extend its features to include AI as well, and the rest of the internet should follow. I am pro AI. I am excited to be able to use it in the future so I can allocate some of the tedious tasks of my art to it so I can focus on what I really want to do with my art: visual story telling. But I understand that I will eventually become another sample in the data sets for these AI in the same way may artists have, so here's my proposed solution: Stability, Lensa and other companies should act as a sort of "spotify for artists" and every time an image is generated, they should present a gallery of all the images used in the sample, as well as links to their portfolios. These should include not just digital illustrators, but also 3D artists, VFX artists, Video editors, photographers, traditional painters, and sculptors among other artistic professions. Since they're making money off of the samples, they should also pay royalties to all the artists being sampled per image generation while also allowing the artists to opt out of they want to.
