I love that this finally happened, because for so long “modern art” has been deteriorating to absolute rubbish (like actual sh!+ in a gallery), and people make money off of and license that kaka. And, okay I actually do have a law degree, if you look at modern art and the lack of any kind of necessitated effort or input in modern art’s creation, then his argument DOES make sense. If a blank canvas can sell for a couple thousand, why can’t a printed piece of AI art? You could argue that by modifying his input, he put in more effort than someone who sold a blank canvas (also not exaggerating; Google it). All in all, I hope he wins a case like this, so we can all start treating modern art like the soulless, pretentious, art-in-name-only trash it is. The only argument that really stands up is that one you brought up at the end, which is that AI generation, while it technically could be classified as a medium, should not have its productions copyrighted, on account that its productions are essentially largely automatic and semi-randomised, syntactically directed reproductions of other artists’ work.
