The problem with AI scraping is not copyright infringement, it's direct cost to those who host the scraped data. Training an AI is 100% transformative, otherwise there would be no need to train the AI because we could copy the works it is trained on, we don't do that because the AI's transformations to the original work is useful on it's own.
