A person is only able to claim FAIR USE because of their USE at the time of the gathering and subsequent publication. In this case AI is returning it to a person who may qualify for FAIR USE, but AI itself cannot qualify for a USE that it does not have or attempt to undertake on its own volition. That is my take.
