Here's the problem though. If you make more restrictive rules for what datasets AIs can be trained on; we'll still have AI art, it's just that it will belong to a tiny set of megacorporations large enough to be able to afford gathering their own images for training. Look at the market for stock-photography. The biggest actors would, without shadow of a doubt, simply require anyone using their platforms to grant permission for AIs to be trained on their work as a condition for working with them at all. And voila; they get image-sets with millions or billions of images that they CAN legally train their AI on.
Meanwhile small and medium companies as well as private citizens, can't do the same thing. So we're then in a world where Disney and Shutterstock and a few others *do* have high quality AI-models that can produce whatever images they want "for free" -- meanwhile any and all smaller companies or individuals competing with them would NOT have access to the same thing.
Result? Further strengthening of already dominant actors in this space.
