How "publicly accessible" are articles that are behind a pay wall? Wouldn't that be more along the lines of fraud/plagiarism/theft? I know it's not really theft since there is nothing being deprived, from the NY times side.
I could see those articles being considered private, or at least that being a relatively strong argument. If the AI didn't pay for the access, I see it as someone getting on a bus with a fake pass and getting a free ride. It's still wrong.
