I find it incredible that these "AI" plagiarists love to evoke "fair use" as if it is some metaphysical right bestowed upon the world from the heavens, that we all must respect and worship in its divine reification. It is a a doctrine of US copyright law which permits the use of copyrighted material and limits copyright in certain ways, originating in the UK's 1740 "fair abridgement" doctrine amending the 1710 Statute of Anne copyright act of Great Britain; the principles of this doctrine were later adopted as common law in the US and then incorporated into the copyright act of 1976. There have been various challenges to "fair use" ever since then, the way the law handles different issues that arise due to the nature of how work is produced and reproduced and how different technologies change factors involved is an issue that is continually addressed in relation to how copyright and fair use law balances the interests of copyright holders and the public. Because things change, the law isn't supposed to remain in some static state demanding that reality accord with it in some futile manner. The way these people talk about "fair use" is like they imagine human beings didn't create it to deal with issues that arise in commerce and in adjudicating between public interest and commercial interests. If the way these computer technologies are developing provokes changes to "fair use" practices in the US, then that is something the law has to adjudicate - if the law has to change in response to changing conditions and standards then, you know, the law changes... If anything, this silly way of evoking "fair use" tells you a lot about how their thinking is informed. In order to rationalise their plagiarism, they will evoke a legal doctrine and transform it, in their imagination, into some metaphysical reality representing some "right" they possess as metaphysical subjects, and any challenge to it is met with some notion that obstructing their "right" to plagiarism is an attack on their natural rights that have been breathed into their beings as human subjects by the breath of God. It is absurd.
