My basic argument against the person prompting being able to claim AI, or against creators being able to claim copyright against AI because it was used to train the AI, is that the AI generated music is fully generated by the computer, it's not made up from sampled clips of actual songs. to get that output, you have to specifically prompt the AI to make it's output be that song, or part of it. AI is like me teaching you guitar, and then telling you to listen to 5 different random rock songs every day for a year, and you can only listen to each song once. Then, at the end of the year, I tell you to write me a rock song about ______ topic. You write me a song based on what you know rock is supposed to sound like because you've listened to quite a bit of rock music in the past year and have gained that knowledge. That's what AI does. Training an AI on rock music isn't putting specific songs into it for it to just cut clips of and use in it's output when someone types a prompt. The AI isnt gonna take the drums from a Poison song, the Guitars from a Motley Crue Song, the vocals from A GnR song and make a mashup. You're giving the AI a general knowledge of what rock music sounds like by making it listen to and analyze a large amount of it. It takes the averages of everything you put in and creates a unique piece based on those averages, any resemblance to any actual copyrighted material is wholly coincidental unless that AI was trained only a certain rock artist in order to gain knowledge of what rock is supposed to sound like. Most music generating AI's are trained on music available on the "open internet", meaning if it's available out there for the AI to find when it scours the entire internet, then it probably contributed to the AI's knowledge of what that genre of music sounds like. Eventually the AI just consumes every piece of music it can find on the internet, recognizes the genre, analyzes things such as what the instruments sound like in that genre, what singers' voices typically sound like in that genre, what tuning is typically used in that genre, etc. to add to it's ever-expanding knowledge. So no, I don't think training an AI can be considered stealing an artists work. Nor can the person who typed the idea into the AI as a prompt be considered the creator of the work.
