Regarding the second question, I would argue as a machine learning researcher that the question of whether it takes existing art as inspiration versus completely steals them depends entirely on how overfitted the model is / how the model is designed. It can be designed to be totally different than what already exists or entirely the same. Personally though, I lean towards considering it theft.
