There's a problem with AI database. Yes. But is a moral issue and not a legal issue. Most artist don't know how AI works and most think that it's a collage but it isn't.
AI learn to recognize patterns through dataset images and human validation. There is copyright issue when there is overfitting. This means that in the dataset an idea is represented with the same image and their is not to much variety.
AI can produce original works coping/mixing styles. Overfitting is somethings that is constantly being corrected in order to minimize this situation. AI users could force the AI to produce overfitting work but in this case copyright can be use against the AI'user if he is selling these products. Therefore, the responsibility is on behalf of the user not the model.
