The Brain like AI is great at random production, the intellectual property part comes in when your Brain randomly generated a useful idea that can be protected by law. Ai is like the 1000 monkeys on typewriters, the epic novel is but a needle in the hay, if a guy finds the needle, our law says he gets to have ownership of it's use if he thought it . Every creation in the mind is an amalgamation of ideas and memes experienced in life, AI generated content is designed to produce in much the same fashion, given our brain software is still far superior. Not all ART is equal and so AI ART will also not be equal, if anti-AI artists don't like it cool, Art is okay with being for those that get it and invisible to the rest. I personally feel like copyright/patent law undermines the collective accomplishments of humanity for the benefit of a human, but hey that Capitalism. So why can ideas generated within the brain be patented, but ideas generated in a machine cannot. Using AI to make creative works might be as big a leap as that from plow to tractor. Whatever works.
