Until this topic is more broadly discussed, perhaps legislated, if companies argue that it is "fair use" to take human-made artwork for their specific purpose, it could be argued that it is equally "fair use" to take any images generated by different commercial, open-source or proprietary models to feed your own image database, to train your own generative AI on - which might potentially outperform theirs.
