I do have a question on why AI art using copyright IP like Ironman is infringement but fanart is not. They are both derivative works. That being said I am happy that AI art can't be copyrighted but I welcome it as a tool. Also about the art being used to be trained for an AI dataset, can't one argue that once you post your art on a social media platform (like twitter) you forfeit that piece to the terms and services of the platform. Alot of terms of services mention the use and distribution of posts to the platforms will. I think while there is a discussion on the ethics of AI art we need to refocus on the ethics of data we provide to media platforms and apps and what rights they have with distributing that data. While some data sets for AI are created through scrubbing sites of media, some data sets are provided by platforms or even used to make AI from the platform themselves (for example Googles' proprietary AI image generating platform). An AI is only as strong as its data its trained on and we may need to confront corporations how they use data technology.
