Gotta point out that it isn't _theft_ because it isn't _criminally_ prosecuted. It's copyright infringement. Yes, it's still illegal, but it's not _theft._ Dowling v. United States is one of the court cases that explicitly point out that copyright infringement isn't theft. "AI art" is useful enough for a home game of some roleplaying system (like Blades in the Dark, GURPS, Draw Steel, et cetera) because it's limited in scope, doesn't involve profit motive, the alternative isn't someone commissioning art from an artist but just not having anything visual and just using words and imagination. Which isn't bad in itself. When corpos are using "AI art" to avoid paying artists for their self-aggrandizing PR it just seems shitty. They've got the money to pay for someone to do things right. Dodge v. Ford Motor Co was a shit precedent. The modern stock market is full of perverse incentives and should've been reformed to something closer to its roots (time-limited ventures which _hopefully_ return a profit _once_ ). And something should probably supersede the Berne Convention with copyright terms better suited to the modern age.
