By that logic, since AI is not copyrightable, then it also can't be a "copyright violation", by the NON-CREATOR. The AI created the violation. The input of the photographer who setup the lighting and camera, was not a factor in the creation process of a tangible creation. You can't have your cake and eat it too. It's an accidental shooting that resulted in a death, because a doctor failed to save a life, the ambulance driver was stuck in traffic, the person shot had a medical condition that stopped the blood from clotting. Sue the guy who dropped the gun that shot a bullet into the sky! We didn't "create" the music and lyrics. Where is the copyrights "Fair, public access to perform due diligence and comparison against copyrighted works?" AI could be doing that too. We just need a scale of comparison, which can NOT be debated or contested. A point where there isn't enough similarity to move forward with infringement claims.
