AI companies just want to exist. Your crazy if you think this is a win. Basically the AI company will get your data now just a more legal way, instead of just scrapping it for free. In the end they still get to grow off of the back of artist, sorta like how YouTube arguable became the biggest media company in the world, and don't even have to upload videos themselves. In the end I don't want to see any artist opt who where against AI generated images, when it become "ethical". If it was not a tool before the free scraping, it doesn't become a tool all of the sudden afterwards. I think one of the most inhuman/human things ever is being hypocritical. Disney and other major corporation will more than like reach an agreement with these AI companies, as they are not trying to protect artist. They are just made that the AI companies are making any sort of money of these generated images/video, and will more than like agree to a ethical settlement. Where artist are ask to opt in to be trained as a stander, and maybe if we are lucky compensated for that work that was trained on. Artist should choose to starve out these AI companies then, since AI art can never be art, although they might find themselves now fight the industry itself.
