The case of second parties "laundering" work that later turned out to be from an original source has happened a lot within standard copyright cases of the past.
The important question is whether the final party that utilised the work reasonably knew that copyright infringement was taking place, or whether they had no reason to believe that the work was derivative.
Say you used a copyright-free sounds pack in your game, but one of the sounds turned out to be copy written. You can claim that you thought it was safe, but if there's evidence the company knows it's not (which could be obtained in a subpoena), then they have no shot.
