To be honest, it's gonna be personal commission artists that are going to be affected. Commercial work is still gonna require artists, as AI art cannot legally be granted copyright protection. Hence, you cannot own an AI image, anyone can legally use that same image for anything. A lot of companies aren't gonna like that.
Now for some more positivity, a few regulations are already in the works, or already happened.
First of all, Microsoft, Github and OpenAI are being sued for violating copyright laws in relation to their AI generators. This lawsuit is still ongoing so we cannot know the outcome, but it's a really good start.
Second, the Concept Art Association is on GoFundMe right now with over $170.000 raised already with the aims to protect artists from AI technologies. They aim to update IP and data privacy laws to address new AI technology, requiring AI companies to adhere to a strict code of ethics and ensure fair and ethical use of their tools. This is a movement central to the US, but other countries will look to the US and impact what is happening internationally.
As for the EU, they are already working on legislation for AI, it's called the Artifical Intelligence Act. It's been in development for a few years and will be moved forward early next year. It is absolutely clear that this Act would require AI to comply to their regulations regardless of where it is located as long as its available in the EU marketplace.
In simple terms, this Act is concerned with whether the AI technology in question is a threat to the livelihood and rights of the people, which definitely involves AI image technology.
Plus, the EU doesn't play lightly with data collection either. I imagine they would consider forcing AI developers to reveal their datasets and enforce a sort of opt-in policy.
Finally, several companies have been outspoken about AI art and mentioning how they believe it will soon be regulated. These companies, such as 3Dtotal and Chaosium just to name a few, mention how they believe the EU will pass legislation that effectively prohibits the webscraping AI programs that now exist, and that the US courts will declare that AI art violates the copyrights of thousands of artists.
These companies have full legal teams, they know a lot more then the average person about what's going on. We can trust their words.
Finally, I understand how demotivating this is to artists, especially starting artists. I hope to spread the word around that art is not going anywhere and US artists will be just fine.
Like I said firstly, personal commission artists will be most at risk from AI which is unfortunate. Personal commissions don't require commercial use or copyright protection. I can just hope that those who commission artists are also those who like supporting actual artists instead of AI.
