Wait wait wait! AI art can't be copyrighted! Since it's not made by a man! There was a legal precedent trying to copyright monkey art. Only human work can be protected.

Also, afaik not all terms of service clauses can be enforced by law. Just because a company has a TOS where you give them your first born it doesn't actually mean you HAVE to give them your first born!
