Just like how using a refrence ≠ tracing someone's artwork there is a massive canyon of difference between someone being inspired by/using someone's refrence and an AI program copying the entire piece (tracing someone else's art and calling it your own)
It's still looked down upon and considered art theft when humans do it and it's no different just because they're using AI instead of a pencil to do a more effective theft.
If I used my IPad to make a counterfeit Mona Lisa it would still be a counterfeit regardless, I don't get to claim it's not because "well its not like I used a paint brush!"
