The biggest problem with the argument that we should have no expectation of privacy when we operate in the public sphere is that there is no way to opt out. As the meme goes, we live in a society. Whether through living conditions or a lack of resources or skills, essentially no one alive today is capable of completely cutting themselves off from the public sphere. Unless you live completely alone, relying on no one for anything, in an area that is unclaimed by any government on the planet, you are in the public sphere in some way. And even assuming that one could completely cut themselves off and opt out of society, having such a desire is treated as an aberrant behavior that has to be stopped. Proponents of that argument say you have no right to privacy when in public, then become immediately suspicious of and hostile towards anyone who does not willingly give up all expectations of privacy ever. John Oliver had a haunting example of this, where someplace in England put up signs that indicated certain areas were being used to test facial recognition software, then fined a man who saw those signs and started to avoid entering those areas.
