As someone studying computer science and working at an IP law firm, I agree this is something that needs to be addressed. However, this is much too complicated for non-IP-attorneys. There is so much nuance in this field, and there is a danger in disallowing web crawlers. Web crawlers are used for AI to generate new products, which is what you’re questioning. But there are MANY kinds of products. One that I am aware of that is being developed is an AI which predicts whether someone will develop Alzheimer’s. Another predicts weather patterns. Both are unfinished but utilize very similar methods to produce results. Disallowing the web crawlers in a photo generating AI might protect artists, but it might also impact the legality of other beneficial AI programs in development. Not only that, but the legal system is partially dependent on AI. E-discovery utilizes AI which also uses a similar searching function to generate matches in large-scale cases. It’s a tricky field. Most attorneys won’t touch IP
