Here's my argument against the "using as reference" thing, and the "its not collage, its not literally copying anything" argument and I would appreciate if you would spread it because I think its a valuable argument: Humans don't need other people's art to make art. We CAN use it but we don't have to. We look at the world, at nature, and produce patterns which replicate what we see, A human sees an apple, you replicate the shape of the apple with a pen, because you have eyes. No one owns the concept of an apple, it exists in nature. AI doesn't have eyes, it can never see the apple, it requires someone else's eyes to take a photo of the apple and feed it to the AI to take in the image patterns which humans made out of the real life apple. AI can only see the apple through images people make. It cannot see anything at all without people seeing the thing first and translating it into patterns. The labor of translating the apple into a pattern that the AI can understand (whether through a photo or drawing) is an intellectual labor and is therefor the creation of intellectual property. It takes intellect and labor to translate life's objects into a pattern that other humans can recognize. Therefor AI requires other peoples intellectual property to function, in fact its output is synthesized from 100% other peoples property. It doesn't copy their artworks in the collage sense, but it does identify and copy their patterns. Those patterns, because they took labor to translate from life, are the artists property. Humans making art live in the real world and encounter real objects all day with our eyes. Only some percentage of our output is based on other people's intellectual property, and nothing close to 100%. The pattern that human produced is an idea, and ideas come from somewhere and have value. We should credit people for the value they produce. An essay writer may not literally pay people for their ideas, but they have a moral, epistemic and intellectual obligation to credit them, otherwise they are being dishonest in their behavior. Pretending your work is not, categorically, 100% synthesized out of other peoples pattern creation effort is a lie.
