I think you missed a big part of this debate. These are the two questions AI “prompters” want to focus on because they can trap you in a philosophical debate over “human vs machine” when the reality of this issue is much more simple.
Companies are taking artist’s work and feeding them into a program with the express intention to use their work for profit without any compensation to the artist. This is theft of IP and is not protected under fair use.
The whole argument that this is the same as someone taking inspiration from someone else’s art or style and creating something new is false because humans have the ability to actually learn and contribute new ideas to their art, something the AI can’t do (even if the developers want to use personified words like “learning” to describe the process of data scraping)
Final point, thus same thing has been happening with music yet all of these companies choose to use royalty-free music or pay the royalties for using the music to train their AI. Why is the same not being expected when it comes to art?
