If the company told the police:  “We have a very low confidence match your suspect may be XYZ recommend investigating them”  then the police are at fault and can’t really blame the company.  However if the company presented it something like. “We have a facial recognition match. The positive match is for XYZ” The latter, I’d argue the company is not blameless. When it comes to the justice system any little “we’ll present it like this because it makes us look better” should come back to bite them if it hurts an innocent citizen. But let’s be honest most Americans would happily vote for a company that does this to a person be removed from existence.
