AI isn't a person. It's a computer program. The question is whether OpenAI as a company needs special license. They're using some dickish "research" excuse even though the "research" arm of the company and the product arm are housed under the same roof. Profit motive comes into play as well as OpenAI has completely dropped the facade of being a research company and is full bore into trying to make Sam Altman a billionaire. Throw this on the pile with the 7 or 8 other major lawsuits against the company. Sam's already admitted none of these tools work without training endlessly on copywrited material. If they had to pay royalties or anything of the sort it would end the company. Sam's in deep shit anyhow as their tools have failed to provide businesses the benefits promised so they'll turn on him sooner or later.
