I can see why it's controversial, but from a moral perspective I can agree with it. If you had no reason to believe that an action that seems normal would hurt someone, it's hard to say that you're "guilty". Similarly, if someone secretly slipped you strong drugs that caused you to act strange and violent, it would be hard to blame your behavior on you.
