at the end of the day, someone can utilise a CCTV system with 8mp cameras and pick up the finest details on your face without facial recognition enabled, however, the raw data(records) still exists. The data simply hasn't had the analytics applied to characterise those features, but this can still be done anytime after the fact. You can even upload the photos to your iPhone and IOS will do it for you. I haven't read the New York laws on facial recognition, but i'd be interested to see what they actually characterise as recognition. Although noting the topic of discussion is for an Amazon store, i'd imagine there would be some pretty advanced analytics occuring, and it also depends on what they're fusing those characteristics with. Do they link it to your purchase, your credit card, your mac address other RF characteristics that your devices are admitting (BLE/WiFi etc).
