It's a little known secret that forensic science isn't actually a science. The NSF made a huge report on it awhile back. Furthermore, the problem isn't the science (or lack thereof) per se, but rather the system that gets faulty tools accepted into the justice system still exists. Lastly, facial recognition software is meant to be just a tool in the investigation/prosecution. It's like trying to build a house using only one hammer. Blame is unfairly focused on the software, rather than the police officers. The judge kept pressing them to produce more evidence and they gave up after 4 court appearances.
