I believe this would allow McGahn to flip the burden to the other side to stop him from testifying. If I were him: "I have a court order and must comply. If anyone wants to stop me from complying, you may do so with a preliminary injunction or stay of the court order."
An appeal doesn't automatically stop compliance/execution of an order. You usually need to appeal and secure a separate order staying execution of the first order.
