Why on Earth did your realtor ever advise you to allow them pre occupancy if there were open questions about financing and the buyer's ability to close? What situation did any of you think you were going to be in if there was some problem with the closing prior to the buyers deployment on military orders? This was extremely, extremely amateur on the behalf of your agent and their broker should be aware of all the terrible decisions and advice that was given to you in the course of this deal. You probably need to hire a landlord tenant attorney to advise you on the swiftest process to deliver notice and immediately begin an eviction proceeding against the unwanted family members and animals in your home present in violation of your pre occupancy agreement. The wording of your pre occupancy agreement will be critical; I presume, although this may not be an accurate assumption, that the occupancy agreement is immediately terminated if the buyer cancels the transaction or fails to obtain financing rendering anybody in the home a holdover tenant. It is unlikely you will be able to get them out sooner than 5/25 but proceeding with the necessary formal notices for an eviction lawsuit will probably light a fire under their pants to come to an agreement with you or voluntarily depart. The buyer's military status may be a substantial complication to the process including both proper service and your legal rights or time frame to file an eviction lawsuit. In my opinion, your real estate agent should participate in the legal fees that you are about to incur because this situation is a direct result of the bad advice you were given on multiple accounts in this transaction.
