I think this particular example would be simple. In the US copyright is automatically given to the creator. If I wrote a poem and posted it on reddit it would still legally be mine. (in reality it would be gone but not legally) so it could not be distributed for profit by someone else. However I think it is still legal to let friends read it and share it at a poetry slam or on a youtube video. You just can't be the owner. But as the OP states there are many overlapping contradictory laws in this area and I feel either position can be supported by choosing the correct laws and ignoring the others. On second thought the statement "I wrote this poem for you" could be considered a transfer of ownership in the form of a gift. Lawyers are going to love these laws :)
