Yes, but that's a separate issue entirely. That's "intimate" images, usually not owned by the person publishing them and with the agreement that they won't be posted online. In civil law however and as far as photographers are concerned, nudity has no bearing whatsoever.
Edit: In other words, your argument is mixing a whole bunch of unrelated laws governing completely different things and there is very little understanding of the civil law you're referring to.
